ASIC v Bekier [2026] FCA 196, handed down 5 March 2026, found a CEO and Chief Legal Officer personally liable for governance failures. The court reconstructed three things from the institutional record:

Information available at the point of decision, not retrospective claims.

What did they do?

Action taken (or not taken) in response, evidenced contemporaneously.
